TERMS OF SERVICE

Overview

Welcome to One Oceania.

The terms “One Oceania”, “we”, “us” and “our” refer to One Oceania.

One Oceania operates this website and related services, including event information, ticketing, registrations, Expressions of Interest, applications, communications, products and other services offered through our website (collectively, the “Services”).

Our website is powered by Shopify, which provides the ecommerce platform that enables us to provide the Services to you.

These Terms of Service, together with any policies referred to within them, set out your rights and responsibilities when using our Services.

By visiting our website, purchasing a ticket or product, submitting an application, registering for an event or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree with these Terms, you should not use our Services.

1. About One Oceania

One Oceania is a Perth, Western Australia-based not-for-profit creative and events platform focused on providing opportunities for creativity, art, culture and connection.

One Oceania creates events and platforms designed to showcase designers, models, artists, performers, creatives and other contributors.

Any surplus funds generated through our events or activities are reinvested into future One Oceania events, creative opportunities, productions, initiatives and platforms that continue to showcase and support our community.

Our not-for-profit status does not exclude, restrict or modify any consumer rights available under Australian law.

2. Access to Our Services

You may use our website and Services only for lawful purposes.

You are responsible for ensuring any information you provide to One Oceania is accurate, complete and current.

Where an account is created, you are responsible for maintaining the confidentiality and security of your login information and for activity conducted through your account.

If you are under 18, purchases, applications or registrations should be made with the involvement and consent of a parent or legal guardian where appropriate.

3. Event Tickets

All tickets are subject to availability.

Before purchasing, ticket holders are responsible for reviewing the:

  • event date;

  • event time;

  • venue;

  • ticket category;

  • seating or access level;

  • inclusions;

  • entry conditions; and

  • other information displayed at the time of booking.

Tickets must not be fraudulently reproduced, duplicated, altered or commercially resold without written permission from One Oceania.

One Oceania may refuse entry where a ticket is invalid, duplicated, fraudulently obtained, cancelled or otherwise used in breach of these Terms.

Tickets must not be used for unauthorised competitions, promotions or commercial giveaways without prior written approval.

4. Ticket Categories

One Oceania may offer different ticket categories, including General Admission, Premium and VIP.

Each ticket category may provide different seating areas, hospitality, benefits, inclusions or access.

Guests are responsible for reviewing the inclusions associated with their chosen ticket before purchasing.

Purchasing a higher ticket category does not create an entitlement to benefits that were not expressly listed as part of that ticket at the time of purchase.

5. Refunds

Ticket purchases are subject to our separate Refund & Ticket Policy.

Unless otherwise required by law, General Admission tickets are non-refundable for change of mind or general inability to attend.

Refund requests relating to Premium and VIP tickets may be considered in genuine exceptional circumstances at One Oceania's discretion.

Exceptional circumstances may include serious illness, significant personal emergencies or other unforeseen circumstances outside the ticket holder's reasonable control.

Supporting information may be requested.

One Oceania does not generally provide refunds because a guest:

  • changes their mind;

  • can no longer attend;

  • has conflicting plans;

  • experiences travel or scheduling difficulties;

  • arrives late;

  • misses part of the event;

  • chooses not to attend; or

  • does not use all inclusions associated with their ticket.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth).

6. Not-for-Profit Ticket Revenue

One Oceania operates on a not-for-profit basis.

Ticket revenue may be used towards costs associated with producing and delivering our events, including:

  • venue hire;

  • production;

  • staging;

  • equipment;

  • entertainment;

  • creatives;

  • suppliers;

  • hospitality;

  • marketing;

  • administration;

  • insurance;

  • security; and

  • general event operations.

Any surplus remaining after event costs will be reinvested into future One Oceania events and creative opportunities.

Because funds may be committed to event delivery well in advance, One Oceania does not generally provide refunds for change of mind or ordinary inability to attend.

This does not affect any statutory rights available under Australian Consumer Law.

7. Event Cancellation

If One Oceania cancels an event and the event is not rescheduled, ticket holders will be provided with any refund or other remedy required under Australian Consumer Law.

Refunds may be processed through the original ticketing platform, payment provider or payment method.

Any booking or transaction fees charged independently by third-party providers may be dealt with in accordance with that provider's terms and applicable law.

8. Rescheduling and Event Changes

One Oceania may make reasonable changes to an event where necessary.

Changes may include:

  • designers;

  • models;

  • performers;

  • artists;

  • speakers;

  • hosts;

  • event schedules;

  • running times;

  • programming;

  • seating arrangements;

  • layouts;

  • hospitality;

  • event inclusions; or

  • other production elements.

Minor changes do not automatically entitle a ticket holder to a refund.

Where an event is rescheduled, existing tickets will generally remain valid for the replacement date unless otherwise advised.

Where an event is materially or significantly changed, affected ticket holders will be provided with any options or remedies required under Australian Consumer Law.

9. Ticket Transfers

Where supported by the ticketing provider, tickets may be transferred to another guest before the event.

The original purchaser is responsible for ensuring the replacement attendee receives the correct ticket and relevant event information.

One Oceania may require attendee details to be updated before entry.

One Oceania is not responsible for private payment arrangements between an original ticket holder and a replacement attendee.

10. Entry and Guest Conduct

Guests must comply with reasonable instructions from:

  • One Oceania staff;

  • event organisers;

  • venue staff;

  • security personnel; and

  • authorised event representatives.

One Oceania or the venue may refuse entry or require a guest to leave where that person:

  • behaves aggressively or abusively;

  • harasses or threatens another person;

  • creates an unreasonable disruption;

  • damages property;

  • creates a health or safety risk;

  • breaches venue conditions;

  • engages in unlawful conduct; or

  • otherwise seriously breaches these Terms.

Removal or refusal of entry due to misconduct does not automatically entitle the person to a refund.

11. Alcohol

Where alcohol is available, its sale, supply and consumption will be subject to applicable Western Australian liquor laws, venue requirements and responsible service obligations.

Valid identification may be required.

The venue or authorised service staff may refuse service where required or permitted by law.

A VIP, Premium or hospitality ticket does not guarantee alcohol will be supplied to a person who cannot lawfully be served.

Where alcohol is listed as part of a ticket inclusion, an appropriate non-alcoholic alternative may be offered where reasonably available.

12. Photography, Video and Recording

Professional photography and filming may take place at One Oceania events.

By attending an event, guests acknowledge that they may appear incidentally in crowd photography, event footage or other recordings.

Such content may be used for legitimate:

  • promotional;

  • marketing;

  • editorial;

  • archival; and

  • event-related purposes.

Where practical, guests who have concerns regarding photography or filming should contact One Oceania before the event or speak with event staff.

Unauthorised professional photography, commercial filming, livestreaming or recording may be restricted.

13. Expressions of Interest and Applications

Submission of an Expression of Interest, application or portfolio does not guarantee selection or participation in a One Oceania event.

One Oceania may select designers, models, artists, performers, creatives and collaborators based on:

  • event requirements;

  • creative direction;

  • suitability;

  • availability;

  • capacity; and

  • other relevant considerations.

Applicants must provide truthful and accurate information.

Selected participants may be required to agree to separate participation terms, releases, schedules, deadlines, rehearsals, fittings or production requirements.

14. Products and Merchandise

Where One Oceania sells physical products or merchandise, we will make reasonable efforts to accurately represent those products.

Colours and appearance may vary depending on:

  • photography;

  • lighting;

  • screen settings;

  • manufacturing; or

  • device configuration.

Product descriptions, availability and pricing may be updated from time to time.

Nothing in these Terms excludes any applicable consumer guarantees relating to products under Australian Consumer Law.

15. Orders and Payments

When you submit an order, you are making an offer to purchase the relevant product, ticket or service.

An order is not final until payment has been successfully processed and the order has been accepted.

One Oceania may decline or cancel an order where there is:

  • suspected fraud;

  • unauthorised payment activity;

  • an obvious pricing error;

  • incorrect availability;

  • payment failure; or

  • another legitimate reason.

Where an accepted order is cancelled by us, any refund required will be processed appropriately.

You are responsible for providing accurate billing and contact information.

16. Pricing

Unless otherwise stated, prices displayed on our website are in Australian dollars (AUD).

The price charged will ordinarily be the price displayed at the time your order is placed.

Third-party ticketing, payment processing or booking fees may apply and will generally be disclosed during checkout.

Prices, promotions and availability may change before an order is completed.

17. Shipping and Delivery

Where physical products are offered, estimated shipping or delivery times may be provided.

Delivery times are estimates and may be affected by third-party carriers and circumstances outside One Oceania's reasonable control.

Nothing in this section limits any right or remedy available under Australian Consumer Law.

18. Intellectual Property

The One Oceania name, logos, branding, website content, promotional materials, graphics and original event materials are owned by One Oceania or used with permission from the relevant rights holder.

You must not reproduce, distribute, modify, sell, republish or commercially exploit One Oceania intellectual property without prior written permission.

Designers, artists, photographers, musicians and other creatives retain ownership of their original creative work unless otherwise agreed in writing.

Nothing in these Terms automatically transfers ownership of a participant's independent creative work to One Oceania.

19. Website Use

You must not use our website or Services:

  • for unlawful or fraudulent purposes;

  • to impersonate another person;

  • to distribute malicious software;

  • to interfere with website security;

  • to obtain personal information unlawfully;

  • to infringe intellectual property rights;

  • to harass another person;

  • to transmit false or misleading material; or

  • to exploit our Services commercially without permission.

We may restrict or terminate access where these conditions are breached.

20. Shopify

One Oceania's website is powered by Shopify.

Shopify provides the ecommerce technology that enables us to operate parts of our online Services.

However, purchases made through our store are transactions between you and One Oceania.

Shopify is not the organiser or promoter of One Oceania events and is not responsible for the delivery of One Oceania events, tickets or products.

Personal information may be processed by Shopify where necessary to provide its services.

Shopify's handling of information is also subject to its own applicable privacy policies.

21. Third-Party Services

One Oceania may use or link to third-party providers, including:

  • Shopify;

  • ticketing providers;

  • payment processors;

  • venues;

  • social media services;

  • email platforms;

  • delivery providers; and

  • other external websites.

Third-party services may have their own terms and privacy policies.

One Oceania is not responsible for independent third-party services except to the extent responsibility cannot lawfully be excluded.

22. Privacy

Personal information collected through our Services will be handled in accordance with our Privacy Policy and applicable Australian law.

Information may be collected and used for purposes including:

  • ticket processing;

  • purchases;

  • applications;

  • event administration;

  • guest communications;

  • customer service;

  • security;

  • payments;

  • marketing where permitted; and

  • event operations.

Because our website uses Shopify and other service providers, certain information may be processed by those providers to provide their services.

23. Feedback

If you voluntarily submit feedback, reviews, suggestions or comments to One Oceania, you give us permission to use that feedback for reasonable business, promotional and service-improvement purposes.

You must not submit content that:

  • infringes another person's rights;

  • is defamatory;

  • is unlawful;

  • contains malicious software; or

  • falsely represents another person.

You remain responsible for material you submit.

24. Errors and Inaccuracies

Occasionally, website information may contain genuine typographical errors, inaccuracies or omissions.

One Oceania may correct errors and update information where reasonably necessary.

This may include information relating to:

  • pricing;

  • descriptions;

  • dates;

  • availability;

  • promotions; or

  • event information.

This provision does not allow One Oceania to avoid obligations arising under Australian Consumer Law.

25. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded.

The Australian Consumer Law is contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth).

Applicable consumer guarantees relating to services include those contained in sections 60–62.

Section 64 prevents contractual terms from excluding, restricting or modifying applicable consumer guarantees and associated rights.

Remedies relating to failures to comply with applicable guarantees for services may arise under sections 267–269, depending on the circumstances.

26. Liability

To the maximum extent permitted by law, One Oceania is not responsible for loss arising solely from circumstances outside its reasonable control.

Guests remain responsible for their own personal arrangements, including:

  • transport;

  • flights;

  • accommodation;

  • parking;

  • childcare; and

  • other personal expenses connected with attending an event.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

27. Circumstances Outside Our Reasonable Control

Events may occasionally be affected by circumstances outside One Oceania's reasonable control.

These may include:

  • severe weather;

  • natural disasters;

  • emergencies;

  • venue closures;

  • government restrictions;

  • public health emergencies;

  • infrastructure failure; or

  • other unforeseen circumstances.

Where an event is affected, One Oceania will communicate relevant information and available options to affected ticket holders as soon as reasonably practicable.

Any consumer rights will continue to apply where required by law.

28. Termination and Suspension

One Oceania may suspend or terminate access to our Services where a person materially breaches these Terms, engages in fraud, interferes with the Services or engages in unlawful conduct.

Termination does not affect rights or obligations that arose before termination.

29. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed or limited to the extent necessary.

The remainder of these Terms will continue to operate.

30. Entire Agreement

These Terms, together with policies expressly incorporated into them, constitute the agreement governing your use of the relevant One Oceania Services.

This includes our:

Privacy Policy
Refund & Ticket Policy
and any additional event-specific terms disclosed before purchase or participation.

31. Governing Law

These Terms are governed by the laws applicable in Western Australia, Australia, together with applicable Commonwealth laws, including the Australian Consumer Law.

Subject to any statutory right to bring proceedings elsewhere, disputes will be subject to the jurisdiction of courts exercising jurisdiction in Western Australia.

32. Changes to These Terms

One Oceania may update these Terms from time to time.

The current version will be published on our website.

Updates will not remove consumer rights that have already arisen or rights that cannot lawfully be excluded.

Where a material change directly affects an existing purchase or registration, we will provide information where reasonably required.

33. Health, Safety, Injuries & Personal Responsibility

One Oceania takes reasonable steps to provide a safe environment for guests, participants, staff and contractors at its events.

By attending a One Oceania event, you acknowledge that events may involve ordinary risks associated with crowded venues, temporary staging, seating, lighting and sound equipment, steps, cables, movement throughout the venue, food and beverage service and other event infrastructure.

Guests are responsible for taking reasonable care of their own health and safety and must comply with all reasonable safety directions provided by One Oceania, venue staff, security personnel and authorised event representatives.

To the maximum extent permitted by law, One Oceania will not be responsible for injury, illness, loss or damage arising from:

  • a guest's own actions, negligence or misconduct;
  • failure to follow safety instructions or venue rules;
  • intoxication or consumption of alcohol;
  • a known or pre-existing medical condition;
  • inappropriate footwear, clothing or behaviour;
  • the actions of another guest or independent third party; or
  • circumstances outside One Oceania's reasonable control,

except to the extent that the injury, loss or damage is caused by One Oceania's negligence, breach of duty or another liability that cannot lawfully be excluded.

Guests should immediately report accidents, injuries, hazards or unsafe conditions to event or venue staff.

Guests with accessibility, mobility or other requirements that may affect their safe participation are encouraged to contact One Oceania before the event so reasonable arrangements can be considered.

Emergency Medical Assistance

Where One Oceania reasonably considers that a guest requires urgent medical assistance, event staff may contact first aid personnel or emergency services.

One Oceania is not responsible for medical, ambulance, hospital or other healthcare costs incurred by an attendee unless liability for those costs arises under applicable law.

Australian & Western Australian Law

Nothing in these Terms excludes, restricts or modifies any right, consumer guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law, Schedule 2 to the Competition and Consumer Act 2010 (Cth).

One Oceania will also comply with applicable Western Australian laws concerning civil and premises liability, including the Civil Liability Act 2002 (WA) and Occupiers' Liability Act 1985 (WA).

34. Age Restrictions

This event is 18+ for ticketed guests.

Selected models, performers, artists or other approved participants under 18 may participate with written consent from a parent or legal guardian and subject to One Oceania’s participant requirements, venue conditions and applicable law.

Under-18 participants will not be served alcohol and may be subject to additional supervision, consent and participation requirements.
